definitions
For the purposes of these General Terms and Conditions
Photographic Work: photographic works as referred to in the 1912, or other works in the sense of Aw
1912, which can be equated with the said photographic works.
Photo: the physical carrier delivered by the Photographer to the Other, which a Photographic work (whether
not recorded by eye), such as a slide, negative, print, duplicate, polaroid or floppy disk.
Photographer: the user in the sense of art. 6: 231 Dutch Civil Code.
Other party: the other party within the meaning of Art. 6: 231 Dutch Civil Code.

application
These Terms and Conditions apply to all legal relationships between a Photographer and
Other party, even after the termination of a contract, unless the parties explicitly and in writing of this
conditions have been waived. Terms used by the other party, be
Photographer explicitly rejected.

Quotation
Offers are not binding unless expressly stated otherwise. The Photographer is entitled to two
days after receipt of the acceptance of his offer to withdraw his offer. The offer does not oblige to
delivery of a portion of the performance at a proportional rate. Quotations are valid for 2
months.

compensation
If no payment has been agreed, the usual fee applicable at the photographer. In front of
insofar as there is a usual rate, the Photographer will be reasonable
and fairness must state the fee, which the photographer will be able to establish among others, (i) in the
market market rates for similar commissions between similar customers and similar
suppliers, with reference to rates like in peer Photographer
charged, (ii) what is right regarded as reasonable and fair in previous cases, (iii)
comparable rates brought by photographers in neighboring countries into account and (iv)
the scope and extent of use of the work required by the other party.
If it is plausible that the Photographer has incurred higher costs and / or made more work, which
were reasonably necessary, then these costs and / or additional work for consideration by the
Counterparty account.

delivery
Photos will be delivered in the building where the Photographer carries out his business. Photos are sent from the
time of transmission risk of the other party. The standard delivery time is 10 working days. If no
delivery time is agreed, it will be reasonably determined by the photographer.
Every delivery, including the delivery of a part of a commission may be separately
billed if a part of the composite order is valued separately.

Possession / ownership of Image Carriers
Photos remain the property of the photographer. The only other party is entitled to transfer the ownership if this
expressly agreed or indicated by the nature of the agreement. Unless otherwise agreed,
the other party has no right to transfer image files or other original recording material, or
duplicates thereof. The ownership of the photos will remain in any case lie with the photographer and any use
of the Photographic Work by any means whatsoever is permitted as long as the other party has not yet fully
compliance with any other obligation arising from any agreement whatsoever with the Photographer.

Complaints
Complaints must as soon as possible but in any case within ten working days in writing to the
Photographer to be communicated. The Photographer has the right within a reasonable deadline for good work
deliver disapproved work, unless this would cause disproportionate damage to the Other Party.

payments
The other party will check the invoice of the Photographer is accurate. If the other party within
ten days after invoice date, the invoice stating the relevant legal reasons
rejected and returned to the Photographer, the invoice shall be binding between the parties have

default
If the Photographer the amount due is not received within the agreed period, the

Any use of the Photographic Work by any means whatsoever is permitted, as long as the other party being
outstanding invoice of the Photographer has not been met or otherwise has not fully met
any other obligation arising from any agreement whatsoever with the Photographer.
The Party shall make payments owed to the Photographer without any reduction or claim to compensation
unless offsetting deductible payments, which he has given to the photographer.

Copyright Infringement
Any use of a Photograph which has not been agreed, is considered a breach of copyright
the photographer. Any infringement entitles the Photographer, without being any right, including the right to
damages, loss, claim compensation amounting to at least three times by the Photographer
usual fee for such type of use, with a minimum of € 230, -.

Publications
The other party is only allowed to publish pictures on social networking sites with a link listing
to the photographer's website.

Promotion
Sjurlie Photography is free to use the photographs as promotion and in its portfolio of its own
website and on its business pages on social media sites (Facebook, Hyves), unless beforehand by the
party is indicated in writing that they do not wish.

Publications
Publication is only allowed with written permission from the photographer. After providing a
corrected and original image file and giving the name and the photographer's website. possibly against
a rate determined by the photographer.
The other party or any third party who publishes a Photographic Work, is the exclusion of others
responsible for obtaining permission of portrayed and other entitled parties. The
Photographer is obliged to cooperate in tracing the persons referred to in this article.

liability Photographer
The Photographer is not liable for damage caused to the other party, unless there is gross
negligence or intent on the part of the photographer or his behalf. The liability is in any
case limited to the amount of the invoice amount.

Bankruptcy / receivership
The Photographer and the Counter Party have the right to terminate the agreement immediately in the event of
bankruptcy or receivership of the other party.

Choice of law,
All cases in which these General Conditions apply are governed by Dutch law.

cancellation
Your appointment for a report, you can cancel by telephone within 48 hours. Cancellations by SMS
have no validity. When the photographer is late cancellation forced the coverage amount on the
other party to charge.
In the case of a wedding photography or communion is canceled within one month from the date scheduled
to take place. In this case, bring the photographer right 25% of the total fee due
lost income.

command
A commission contract is an agreement in which the Photographer undertakes to the Other Party
create photographic works and / or supply.
An assignment agreement is concluded by the acceptance by the other party of the offer of the Photographer.
Acceptance of the other party can be established by a confirmation of the order by email or by
post return the signed quotation.
Changes to the contract by the other party for any reason, and pending the implementation of the
contract agreement shall be borne by the other party and will only be by the Photographer
performed after separate quotation of additional costs has been signed for approval by the other party and to the
Photographer returned.
The photographer has the right to everything that is not explicitly described in a commission agreement to
to conduct its own technical and creative insight.

relevance
Applicability of the general conditions of the other party is hereby expressly rejected

price
All the prices listed on the photographer's website are subject to typing errors. All prices
include VAT.

Actions / coupons
If there is a coupon or discount promotion is always to deliver a maximum of 1 voucher per (bridal) report.
Rebates and discounts do not apply to already made repo fads.

 

In all these conditions are governed by Dutch law.
